Since 1977, the European Patent Office has been granting European patents valid throughout geographical Europe in a single examination procedure. However, maintenance and enforcement have so far only been possible at national level. In 2023, this has changed significantly, opening up new opportunities. The unitary patent makes it cheaper to maintain patent protection for most EU Member States. The European Patent Court offers the possibility of enforcing patents in numerous countries simultaneously. The process is more efficient, cheaper and faster. Existing European patents are also affected by the new jurisdiction, although there is an option to opt out.
