New digital technologies such as AI and ChatBots offer manufacturing companies a wide range of highly lucrative new digital business models. But these digital business models also create new risks of digital patent infringement.
The discussion around this post revolved around the following topics:
- Do digital inventors realise they are inventors and how can we make them aware of intellectual property?
- How can agile IP management help reduce the risk of digital patent infringement?

How are AI generated IP portfolios built today?
Will we invent tomorrow with genAI ๐ค? Not only that, we already do that today - millions of times ๐ฒ! You can learn this from Google! Deepmind (a subsidiary of the Alphabet Group, which also owns Google) has found 2.2 million new crystals and thus possible new materials for, for example, superconductors or batteries. Deepmind has revolutionized materials science.

How can startups patent their innovative software? By Erdem Kaya, Founder of Erdem Kaya Patent
Today, there is almost no business model that is not related to software, and many startups are trying to find a place in their target markets by developing software-oriented solutions. Then one of the first questions that comes to mind is: how can I protect my software from being copied in order to gain a share of the market and stay competitive?
As a preliminary information, generally, software that solves a technical problem can be a candidate for being patented, while software that solves non-technical problems cannot be patented. An example of non-technical problems are administrative problems related to finance, human resources, etc.

Understanding Europe and its Intellectual Property Landscape: A Basic Guide By Martin Schweiger, Owner Schweiger & Partners
The European Union (“EU”) is a significant entity in Europe, but it doesn’t include all European countries. Notable exclusions are Switzerland, Albania, Macedonia, Montenegro, and Serbia, as well as Türkiye and Tunisia. The EU has its own legal systems, like the Court of Justice of the EU (“CJEU”, formerly “ECJ”) and the Unified Patent Court (“UPC”), which applies to EU member states participating in the UPC system when it comes to litigation and to some issues with European Patent applications when it comes to questions such as Arrow Declaratory Reliefs.

When it comes to effectiveness and efficiency in IP management, this can only be achieved based on a high-quality IP management system. No matter which aspect of IP management an organization wants to tackle, it is vital that the processes and procedures as well as the underlying guidelines and policies are implemented in a way that supports the company’s business. As in many areas of an organization the quality of an IP management system is measured by its outcome and the resources that a company is required to invest to achieve such outcome. Therefore, a high-quality IP management system must be effective and efficient.
